    I have been listening on Radio Fiji One for the last two hours and there have been no announcement or newsbreak at all about the court case.
    It is replaying an interview of Sitiveni Raturala by the late Salote Koroi way back in 2003.

    What a shame!!!

    Qarase’s removal unlawful, Fiji court rules

    Fiji’s Court of Appeal has declared that the removal of Laisenia Qarase and his ministers from government in a military takeover in December 2006 was unlawful, and has ruled it lawful for the President to appoint a caretaker Prime Minister to issue a writs for general elections.

    However, it has ruled against the argument by Qarase’s lawyers that he be reinstated and that he advise the President to dissolve Parliament and call fresh elections, given the length of time since Qarase’s removal.

    Instead, the three judges have ruled that the President appoint an independent person as caretaker Prime Minister, who would then advise President to dissolve parliament and make way for elections.

    The court has made the decision on the basis that if the President’s powers of prerogative did exist after Fiji became independent, they did not exist after the 1997 Constitution came into effect.

    The issue of the President’s powers of prerogative, through which the interim administration was appointed, has been the crux of the appeal brought by Qarase against a High Court ruling last year that validated the President’s actions and his appointment of the interim government.

    The court has granted Solicitor-General Christopher Pryde leave to appeal the judgment.

    After the court handed down the decision, Pryde asked that a stay be granted on the decision, given the seriousness of the case.

    However, the judges ruled it was not an appropriate case to grant a stay.

    Listening to the news right now on Radio Fiji One and they are saying that they still awaiting the courts decision. Can you believe it, it is now 4.07 pm in Suva.

    Switched to Viti FM and same story!!

    Something is definetly cooking and only people with internet access knows what has happened.

    I agree ….I suspect we are going to hear the abrogation of the constitution very soon. They will not abide by the FCA ruling.

    I am so so elated with this great news of joy. Of course it was coming this way as nothing is legal about a coup and if tested by law it will always be found illegal. It was so blatantly shameful the way iarse was talking about power vacuum and other garbage about catching the bus and so on. Just get the heck out or else he should be charged with contempt. Old puppy puppet pressie should immediately call for a caretaker govt who would work immediately towards elections. To iarse dont worry about power vacuum let the PS’s commissioners and senior civil servanta take care of business in the mean time while you get the ‘f#$k’ out of here asap, like now. Thank you Lord for bringing joy to our hearts once again.

    iarse was using that as an excuse again to keep them in power.It’s interesting to hear stupid excuses he was concern about! Where was he before the coup,anyway! The people of Fiji are qualified to run the country. He is worried bcos he knows that he can’t return to Aussie!

    The best news I’ve heard in the last 2 years. Where to from here Frank? Abide by the court ruling and Teleni, Leweni, Naupoto and Co. better pack up and go back to where you belong or march into Korovou gaol.
    In the words of the turaga Tui Cakau, “E sega ni ura me sa tei damu ia ni sa damu ena qesa qesa sara ga”.
    I thank God for the court ruling which proves that God is faithful and he allowed the interim government to rule for a short span of time so that we know which people want to alienate the Fijians in their own country. They forget that we are an endangered specie as there are only about 500,000 in the whole wide world. Yes God hears and answers prayers.

    All the rhetoric and negativity is in vain. Frank will achieve his gaol.Best we can do is to go along with him, get the parliament back, then explore the possibilities of prosecution. In the meantime be a sport its only a game of politics..Cheers to both sides.
